Property FAQ

Common Questions About Conveyancing

A Sale and Purchase Agreement, commonly called an SPA, records the parties’ rights and obligations in a property transaction, including the property, price, payment stages, completion period, remedies and conditions.

A straightforward sub-sale commonly allows three months for completion after the relevant commencement date, with an extension where agreed. Financing, redemption, state consent and title issues can affect timing.

Real Property Gains Tax is a tax that may apply to gains on a disposal of Malaysian real property or shares in a real property company. The applicable treatment depends on the disposer, acquisition date and current law.

Certain land dealings require prior approval from the relevant State Authority—for example because of a title restriction, foreign interest or other land category. The requirements and timing differ by state and transaction.

Form 14A, often called the Memorandum of Transfer, is the prescribed instrument used to transfer registered ownership of land or strata title under the National Land Code.

The existing financier will usually issue a redemption statement and, once paid, release its security. The solicitors coordinate redemption with the purchaser’s financing and completion monies.

The estate is administered under the applicable intestacy rules. An eligible person usually applies for Letters of Administration before estate assets can be collected and distributed.
